1. What this covers
1.1 This notice explains what is stored on your device when you use our website or app, and what is sent from it. It sits alongside the Privacy Notice, which explains what we do with personal information generally.
2. What is strictly necessary
2.1 Your sign-in session. Stored by our authentication provider so that you stay signed in and so that pages can tell it is you. Without it you cannot use an account. It is cleared when you sign out.
2.2 Security and load balancing. Our host sets short-lived values that keep requests working and protect the service from abuse.
2.3 These cannot be turned off without the service ceasing to work, and we do not ask your consent for them.
3. What we store on your device for your convenience
3.1 Your theme choice and similar display preferences.
3.2 Whether you have seen a notice, so that it is not shown again.
3.2A An Affiliate’s code. If you open our website through an Affiliate’s link, the code in the link is kept on your device for thirty days, so that the Affiliate is credited if you come back and buy later. You can change or clear it in the code box at checkout.
3.2B Your basket and checkout details. While you shop, your basket and the details you type at checkout are kept in that browser tab, so that nothing is lost if the page reloads. They are cleared when you close the tab or when your order is placed.
3.3 You can clear all of these by clearing site data in your browser. Nothing is lost but the convenience.
4. What only happens if you ask for it
4.1 Push notifications. If you enable them, your browser creates a subscription and we store it so that we can send you a message. Disable notifications and it stops.
5. What is sent to others
5.1 Map tiles. When a map is shown, your device requests tiles from MapTiler. MapTiler sees your device’s network address and the area you are looking at. It does not see who you are.
5.2 Fonts and icons are requested from Fontshare and from a content delivery network, which see your device’s network address.
5.3 That is the whole list. There are no advertising pixels, no third-party analytics scripts, no social media trackers and no cross-site tracking of any kind. We do not sell or share what you do here with anybody for advertising.
6. Our own analytics
6.1 We record which pages and features are used, against your member record, so that we can see what works and what does not. This is our own record, held with your other account information under the Privacy Notice, and is not shared with any advertiser or data broker.
6.2 You may ask us to stop, at sales@ohmicoffee.co.za. Some record of use is kept regardless where it is needed for security or to investigate a problem.
7. Changes
7.1 If we add anything that stores or sends information from your device, we will update this notice before it goes live.
General provisions
Entire agreement. This document, together with the other OHMI documents it refers to, records the whole of the agreement between you and us on its subject. No representation, undertaking or term not recorded in these documents binds us.
Variation. We may amend this document. We will give you at least fourteen days’ notice of an amendment by notice in the app or by message to the contact details you have given us. An amendment does not alter the price, calculation or entitlement of any order placed or benefit earned before it takes effect. Continued use of the service after the effective date of an amendment is acceptance of it.
Severability. If any provision of this document is found to be unenforceable, it is severed and the remainder continues in force.
No waiver. Our failure or delay to enforce any provision is not a waiver of it.
Assignment. You may not cede, assign or transfer any right or obligation under this document. We may cede or assign to a successor in business on notice to you.
Force majeure. We are not liable for any failure or delay caused by an event beyond our reasonable control, including supplier failure, courier failure, power or network outage, strike, fire, flood, epidemic or act of government.
Notices. Notices to us go to sales@ohmicoffee.co.za or to Unit 42 Wesley Road, Galloway Centre, Strand, Western Cape, 7200, our address for service. Notices to you go to the email address, phone number or in-app inbox on your account. A notice sent by email or in-app message is deemed received on the business day after it is sent.
Governing law and jurisdiction. This document is governed by the law of the Republic of South Africa. You consent to the jurisdiction of the Magistrates’ Courts, without prejudice to our right to approach the High Court, and without prejudice to any right you have to approach a consumer body under the Consumer Protection Act, 68 of 2008.
Interpretation. Headings are for convenience only. “Including” means including without limitation. The singular includes the plural. A reference to a statute is to that statute as amended.
Precedence. Where this document conflicts with the Terms of Use and Sale, the Terms of Use and Sale prevail. Where this document conflicts with mandatory law, the law prevails and this document is read down to the extent necessary.
